DeleteAt multiple meetings, the board stated there were only 3 options: convert the space; a full service restaurant; or leave vacant. Two years ago, I sent the following suggestion to 2 board members and it has been completely ignored.
DeleteHire experts to investigate the feasibility of converting the restaurant space into a food court with a bar and 2 or 3 small 'mom and pop' fast food type of restaurants. These restaurants can successfully operate with less income as they have very low overhead as compared to a full-service restaurant.
They would not have to pay for a manager; assistant manager; chef; sous chef; kitchen prep help; serving staff; busboys; hostess; cashier; bar manager; bartenders; linens; silverware; etc. as a full-service restaurant requires.
Based on my ownership of 2 successful fast serve restaurants, I do not believe a massive subsidy would be necessary to attract tenants. There are literally hundreds of 'want to be' restaurant operators that are willing to invest their own money in their dream.
They will compete with each other to provide residents the best food variety, quality and price point. Possible concepts would be soup and sandwiches; burgers; Italian/pizza; Greek; Chinese; fresh on-site bakery. They could provide sit-down; take-out; delivery; and cater club events.
The board has expressed their opinion the kitchen area is too large compared to the seating capacity. This is actually a positive factor for this type of concept since it would be shared by more tenants.
Restaurants have a high failure rate and therefore, turnover can be expected. However, not all will fail at the same time and therefore, at least one will remain open until a replacement tenant is found.
Would the New Traditions teams consider this concept ?

DeleteThere is an issue raised by the New Traditions group which stated they will “Work to restore relationship with The Foundation Assisting Seniors”. I have been a long-standing supporter of this organization and I am aware their dispute over occupying SCA premises was settled in court. Since they moved to a new location, they continue to thrive and provide services to SCA seniors.

DeleteWhen the last company, G2G, was being considered by the Board for the restaurant space, many of us learned that there were a number of additions that were to be included in the lease agreement that were a surprise to residents that included just about everything free.
ReplyDeleteRent, Spirit advertising, DirecTV, utilities, exclusive catering, and who knows what else.
Would any of you accept such terms in any lease agreement?
Would you have withheld the details like the Board did, other than it taking a detailed examination of association records to find it?

DeleteI've been told that the General Manager is now being referred to as The Chief Operating Officer; that she received some kind of employment contact from the current Board of Directors and that they have refused to disclose any information that pertains to its terms, claiming confidentiality.

If you are elected to the Board, would you take the same position of confidentiality, or would you take steps to reevaluate the decision and disclose its terms?

ReplyDeleteI attended the SCA Board meeting on Thursday, February 28, 2018 and witnessed the association attorney in attendance. Actually, I was infuriated seeing him there knowing his presence wasn't free of charge.
That must have cost homeowners a fortune for him to sit there. It was more than obvious the Board was looking to justify the 1,875 violation letters that were sent to unsuspecting homeowners.
I could not believe one man was cited for putting out his garbage, but stated it was Garbage Day when doing so.
Do you think it is necessary to have a high priced attorney in attendance at such meetings?
One of your goals and commitment if elected, is "Review and Evaluate Administrative and Operating Cost Necessary to Maintain a quality community".
Is a reevaluation of association legal services and fees part of this goal?

ReplyDeleteWhile I didn’t attend the candidate meeting, I did watch the entire video of that meeting and believe it is a sound slate of candidates. What I gleaned from your various comments, particularly in regards to the recent compliance enforcement program and changes to the Chartered Club Guidelines and Rules, is that you as a whole feel the board and the self-management team need to be more sensitive and responsive to members (i.e. homeowners) in both their actions and communications.
Having been both a treasurer and an at large board member of a large Chartered Club during the recent era of self-management, I am sympathetic to your concerns. With that said, I am interested in understanding the specific steps your group intends to take, if elected, in regards to your goal to “Return Administrative Operations of SCA Clubs to Their Members”, giving due consideration to the legal liability our HOA has in regards to the activities /actions of chartered clubs.
On a different note, as I was at one time a Las Vegas Master Gardener, I thought I would respond to Rana’s frustration with the ban on Olive Trees.
The following is an excerpt from an article from the Channel Eight website indicating that it is Clark County that bans fruit baring olive trees because of this tree’s prolific production of pollen:
“It's illegal in Clark County to plant European olive trees. The ban was imposed 13 years ago because of excessive pollen created by olive trees. But there are exceptions to the rule. Two varieties of so-called fruitless olives are legal to plant here because they supposedly produce little or no pollen. But sometimes, it doesn't work out that way."
The pollen problem in Las Vegas ranks among the worst in the nation, which is why the ban on new trees was enacted years ago. But government enforcement of the anti-pollen ordinance is sketchy at best, in part because no one seems to know how to tell a good olive from a bad olive. It gets even more complicated when it turns out that the government is responsible for planting more of the accursed trees.”

DeleteYour Team made me curious about reading certain items in the SCA Board Book and one thing I noticed was that the C.O.O. has the authority to sign any contract up to $50,000 without notifying the Board for approval.

It seems like alot of money for a person to spend without an approval from a Board of Directors.
Am I reading that correctly?
If so, what your views on this and would you, if elected, alter that amount?

ReplyDeleteYour message of change is being received by many, and I commend each of you for taking a high road and addressing the issues and explaining your objectives if elected to the Board.I wish the other candidates would be as receptive to answering resident questions and concerns as your team has been.
It gives the residents an indication of your future decisions.
I have been to a number of Board meetings over the years and look at them not as informative, but tedious; that decisions have been made well in advance of any formal vote and that comments or suggestions from the residents are more or less treated as having to listen to them, rather than looking at them for suggestive change.
I think 30-40 people in attendance at the average meeting says it all as to their interest to residents and effectiveness.If elected, would you consider any changes to the board meetings, and if so, what might some of them be?

DeleteAfter having read the questions and comments from many of the visitors to your site, it is clear that your team has correctly diagnosed that many folks in our community do not feel they are being listened to or that their opinion matters. I applaud your efforts to make board meetings more cordial and conducive to having real discussions rather than just votes. ( I note that encouraging discussions will make it difficult to finish meetings in 1.5 hours but it is possible)
ReplyDeleteHowever to me the real test of a good board leader ( based on my experience on prior boards) is to describe how you as a new member will 1) develop some type of learning/ listening process to discover minor problems before they become major problems and then 2) prioritize which problems are important for Board members to weigh in on or solve vs which problems should be solved by the staff or just by small committees of home owners.
So my question to each board member candidate, is :
How will do you plan to discover or learn about issues important to our community before they become real problems ( for example past problems found at Liberty Center or the sewage lines) and how would you prioritize which problems you need to get yourself or the Board involved in.

You've all had positions that have given you life experiences in working with other people.
As a board member, how would you approach the inevitable situations where you don't agree with other board members, or want a different direction from other board members?

What happens if residents agree to a subsidy if no other solution can be secured?
2. If we own and operate our own restaurant/bar facility, the present board says they will not sign their names to any application for alcohol or gambling.
Would you guys be willing to do so if Henderson will allow sufficient gaming machines to make the restaurant pay and no lessor is to be found?
3. Any of you have objections to gaming at the bar if there is a bar ?
Comment; food court is interesting, is there a possibility for an alcoholic drink supplier- beer, wine?. Entry to food area from outside is rather tedious, though convenient for mah-jong players- problem there. Personally, heavily endorse a restaurant/bar situation or other. Do your best—the present board hasn’t.

ReplyDelete1. Does The New Tradition Team support changing the architectural rules to limit tree height to the height of your roof?
2. Do you support: Modify the retaining wall rule which makes sharing parties equally responsible.
Include the caveat: If found the roots of a tree planted on their property roots caused the damage to the retaining wall, be solely responsible for the repair.

ReplyDeleteDid you know that in 2006, AARP proposed a "Bill of Rights for Homeowners"?
Here they are and here is my question to each of you:
If elected, do you believe such a standard should be a part of how a Board of Directors should act toward owners in their association?
I. The right to security against foreclosure.
An association shall not foreclose against a homeowner except for significant unpaid assessments, and any such foreclosure shall require judicial review to ensure fairness.
II. The right to resolve disputes without litigation.
Homeowners and associations will have available alternative dispute resolution, although both parties preserve the right to litigate.
III. The right to fairness in litigation.
Where there is litigation between an association and a homeowner, and the homeowner prevails, the association shall pay attorney fees to a reasonable level.
IV. The right to be told of all rules and charges.
Homeowners shall be told – before buying- of the association’s broad powers and the association may not exercise any power not clearly disclosed to the homeowner if the power unreasonably interferes with home ownership.
V. The right to stability in rules and charges.
Homeowners shall have rights to vote to create, amend or terminate deed restrictions and other important documents.
When an association’s directors have power to change operating rules, the homeowners shall have notice and opportunity, by majority vote, to override new rules and charges.
VI. The right to individual autonomy.
Homeowners shall not surrender any essential rights of individual autonomy because they live in a common-interest-community.Homeowners shall have the right to peaceful advocacy during elections and other votes as well as use of common areas.
VII. The right to oversight of associations and directors.
Homeowners shall have reasonable access to records and meetings, as well as specified abilities to call special meetings, to obtain oversight of elections and other votes, and to recall directors.
VIII. The right to vote and run for office.
Homeowners shall have well-defined voting rights, including secret ballots, and no director shall have a conflict of interest.
IX. The right to reasonable associations and directors.
Associations, their directors and other gents, shall act reasonably in exercising their power over homeowners.
X. The right to an Ombudsman for homeowners.Homeowners shall have fair interpretation of their rights through the state Office of Ombudsman for Homeowners.
The Ombudsman will enable state oversight where needed, and increases available information for all concerned.
